IN CONSIDERATION OF Club Ski 30 (“the Club”) accepting my application for a membership in the Club:
“Club-related Activity” means any activity organized by, or offered under the auspices of, any one or more of the Releases, whether sporting or otherwise and whether taking place during Spring, Summer, Fall or Winter and includes travel to and from such activity, whether or not such travel is organized, co-ordinated or condoned by the Club;
“Releases” means CLUB SKI 30 or any one or more of its directors, officers, employees, agents, representatives, or co-coordinators.
ASSUMING OF RISKS – SELF:
Each Applicant named above realizes that any Club-related activity may involve risk, danger or hazards including negligence of other participants; or negligence on the part of one or more of The Releases. Each Applicant freely accepts and fully assumes all such risk, danger and hazards and the possibility of personal injury, death, property damage and loss resulting therefrom.
ASSUMING OF RISKS - FAMILY MEMBERS:
As the Club allows, as part of certain activities, the participation of family members of a member, each Applicant named above recognizes that each such family member is exposed to the same risks, dangers and hazards as described above and the said Applicant hereby freely accepts and fully assumes - on behalf of Each and every such family member of the Applicant - all such risks, dangers and hazards and the possibility of Personal injury, death, property damage and loss resulting therefrom.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
Each Applicant freely agrees as follows:
TO WAIVE ANY AND ALL CLAIMS that I - or any of my family members - have, or may in the future have, Against the Releases; and
TO RELEASE the Releases from any and all liability for any loss, damage, expense or injury including death that I - or any of my family members -may suffer DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE ON THE PART OF THE RELEASEES, AND INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF ANY CLUB-RELATED ACTIVITYS as a result of my - or any of my family members - taking advantage of or participating in any Club-related activity; and
TO HOLD HARMLESS AND INDEMNIFY the Releases from any and all liability for any damage to property of, or personal injury to, any third party, resulting from my - or any of my family members - taking advantage of or participating in any Club-related activity.
This Agreement shall be effective and binding upon me, my family members, my or their heirs, next of kin, executors, administrators, assigns and representatives, in the event of my or their death or incapacity.
This Agreement shall be governed by, and interpreted in accordance with, the laws of the Province of Nova Scotia.
Any litigation involving the parties to this Agreement shall be brought in courts located within the Province of Nova Scotia.
In entering into this Agreement I am not relying upon any oral or written representations or statements made by the Releases with respect to the safety of any Club-related activity other than what may be set forth in this Agreement.
